Conditions of Use

These terms and conditions set out the entire liability and obligations as between FLAIR RAIL (’Flair’) and all users of the web site including those who view and those who purchase goods (’You’)

All designs, pictures, other graphics, text, software and the source code and any other material presented on this Web Site (collectively the ’Materials’) are the property of and/or copyrighted or otherwise licensed to Flair. You are granted a licence which solely permits You to print portions of the web for the sole purpose of purchasing goods from the web site. All other use of the Materials, including but not limited to modification, distribution or replication, including the copying of images and descriptions, whether for personal or business use, are strictly prohibited unless such prior permission is given in writing by Flair.

Trademarks:

Company names or product names displayed on the web site may be trademarks, registered or otherwise, of other companies.

Terms and Conditions of Sale :

Any goods selected by You will be an offer to purchase those goods from Flair. Once your offer is accepted by Flair as defined below, the transaction will form a legally binding contract between Flair and You as defined by English law

No contract will exist between Flair and You for the sale of any product unless and until Flair has accepted your order.

Acceptance of your order will be communicated to you by an e-mail confirming that your order has been received and payment has been successfully processed by Flair. This e-mail will also confirm the estimated date of dispatch of your goods.

Flair do not accept cash on delivery (’COD’) orders. Acceptance of your order will only occur when payment has been successfully processed. Any orders purporting to be COD will be rejected by Flair.

In the unlikely event that goods You offer to purchase become unavailable to purchase between You placing your offer and Flair’s acceptance of your offer, whether due to manifest error as to pricing or description, technical issues, unavailability or for any other reason whatsoever (’Unavailable Items’), then You will immediately be informed, Flair will not accept your offer to purchase as it relates to Unavailable Items and your credit card will not be debited for the cost of the Unavailable Items.

Flair will make every reasonable effort to ensure that the web site accurately reflects any changes to prices as soon as practicable. However, prices or availability of goods may change between You placing the goods in your shopping cart and receipt of your offer by Flair. In the unlikely event that this occurs then such goods will be treated as Unavailable Items.

Flair do not substitute goods without your prior consent.

Flair accepts Visa & Mastercard sterling payments. We also accept in the UK only, debit cards such as Visa Delta and Switch through our secure server in sterling. Alternatively, Flair accepts cheques in sterling made payable to Flair. In the event that you wish to pay via cheque please print off your shopping cart and send this, with your cheque, to:

Flair will communicate acceptance of your order by telephone or in writing upon clearance of your cheque.

Privacy:

Flair will not share your personal information with anyone, except as is required to fulfil your order. Please see Flair’s Privacy Policy.

Faulty Goods:

In the unlikely event that your goods are found to be faulty then Flair will provide a full refund or replacement once returned to Flair. This does not affect your statutory rights under English law.

Cancellation of Order:

Under the UK statute law called The Consumer Protection Distance Selling Regulations 2000 (which may be amended from time to time), You have the right to cancel your contract for the purchase of your goods at any time up to seven working days after delivery. (’Cancelled Goods’)

You may cancel your order at any time prior to acceptance by Flair by simply calling us on 01621 786198, or, if You prefer, e-mail us at CustomerService@flair-rail.co.uk.

In the event that You wish to cancel your order after acceptance of your order by Flair, then this must be communicated to Flair within seven working days after delivery. You will need to call us or e-mail us at CustomerService@flair-rail.co.uk. If Flair has already shipped your Cancelled Goods then You will need to return the Cancelled Goods to us at your sole cost.

If we do not receive your Cancelled Goods back from You then we may arrange for collection of the Cancelled Goods. This will be at your sole cost.

We will refund the relevant cost of your Cancelled Goods when the Cancelled Goods are received by Flair. This will be done as soon as practicable and in any event within 30 days after receipt of the Cancelled Goods by Flair.

To the fullest extent permissible by law, Flair provides this web site on an ’as is’ basis and makes no representations or warranties of any kind, express or implied, with respect to either the web site or the content, information, materials, pictures or products displayed on the web site. This includes, without any limitation, any warranties for fitness for a particular purpose, performance, use, quality or merchantability of goods, whether express or implied, by English Statute Law, English common law or otherwise.

Pricing and product availability is subject to change without notice and Flair makes no representation, or gives any warranty, that the contents of the web site are accurate or current or complete.

Except where Flair state otherwise on this site, to the fullest extent permissible by law, Flair excludes liability for damages arising out of or in connection with, the use of this web site or the Materials contained within this web site, or the goods included within this web site. This exclusion of liability applies to all damages including but not limited to loss of profit or loss of income, loss of data, property damage whether each loss is determined to be either a direct or indirect loss under the common law of England.

Nothing in this disclaimer is intended to limit Flair’s liability for death or personal injury to the extent that this arises as a result of the gross negligence of Flair.
